Good news for New Yorkers! A Judge ruled against proceedings to ban soda bottles larger than 16 ounces from places including movie theaters, sporting events, convenient stores, and restaurants.
It seems New York City Mayor Michael Bloomberg has gotten beside himself. The mayor is lobbying for regulation of portion control and consumption of soft drinks among New Yorkers. Earlier this afternoon Judge Milton Tingling stopped the proceedings to limit the size of soda bottles to no more than 16 ounces. “[The city] is enjoined and permanently restrained from implementing or enforcing the new regulations,” Judge Tingling ruled.
As for Tingling’s reason for permanently stopping the law from taking effect? “It is arbitrary and capricious because it applies to some but not all food establishments in the city, it excludes other beverages that have significantly higher concentrations of sugar sweeteners and/or calories on suspect grounds, and the loopholes inherent in the rule, including but not limited to no limitations on refills, defeat and/or serve to gut the purpose of the rule,” Tingling wrote.
As expected the Mayor wasn’t too thrilled. During a press conference he stated, “I got to defend my children and you and everybody else and do what’s right to save lives.” “Obesity kills. There’s just no question about it,” he continued.
“This is not a political capital thing,” Bloomberg added. “This is just one human being to another. This is what we got to do.”
The Mayor plans to appeal the judges ruling.
What do New Yorkers think? For some, although the law has been pegged to be steps taken in helping with health concerns of the city’s residents they believe it is also a tactic to increase revenue. If you restrict the size of soda bottle consumers may opt to purchase more soda bottles right?
The ban against soda bottles larger than 16 ounce bottles was schedule to take effect tomorrow, Tuesday, March 12th, 2013.

I think that was stupid for him to try and do this… Because at the end of the day I think people would have just brought two small sodas instead of one big one.

They should be banned. Look how many people have quit smoking since all of the bans have been put in place (at least here in Canada). Obesity kills, but we have a culture of gluttony. need to make people rethink things.
People should have the right to drink what they want….bottom line
